General Terms and Conditions of Sale and Service

1. Scope of Application
These general terms and conditions (hereinafter "GTC") govern the contractual relationship between Welcome Service Sàrl, Rue Zurlinden 6, 1207 Geneva, Switzerland (hereinafter "the Provider" or "My Swiss Relocation") and its clients (hereinafter "the Client"). Any order of services implies unreserved acceptance of these GTC.
2. Services Offered
My Swiss Relocation offers relocation services including, depending on the package chosen: assistance with work and residence permit procedures, housing search (temporary and permanent), support with administrative procedures, school orientation and enrollment, international moving coordination, and any other service defined in the quote. The exact scope of services is defined in the quote or contract signed by both parties.
3. Quotes and Orders
All services are subject to a prior quote. The quote is valid for 30 days from its issue date. The order is confirmed by signing the quote or contract and paying the required deposit. The Provider reserves the right to modify its rates at any time for new quotes.
4. Rates and Payment
Rates are expressed in Swiss francs (CHF), exclusive of taxes. A deposit of 50% is due upon contract signature, with the balance due upon completion of the service. Payments are accepted by bank transfer. Any late payment automatically incurs default interest of 5% per annum, in accordance with Art. 104 of the Swiss Code of Obligations.
5. Provider's Obligations
My Swiss Relocation commits to performing its services with diligence and professionalism, in accordance with professional standards. Our obligations are obligations of means, not of result. We cannot guarantee the granting of a work permit, the allocation of housing, or admission to a school, as these decisions rest with third parties (authorities, agencies, institutions).
6. Client's Obligations
The Client commits to providing accurate and complete information, submitting requested documents within agreed timeframes, responding to the Provider's requests within a reasonable time, and paying invoices by the due dates. Any delay in providing documents or information by the Client may result in a delay in service delivery.
7. Confidentiality
The Provider commits to treating all information communicated by the Client in the course of the service as confidential. This confidentiality obligation survives the termination of the contract. Personal data is processed in accordance with our privacy policy.
8. Cancellation and Termination
The Client may cancel their order within 14 days of signing the contract, free of charge. After this period, the deposit paid is retained by the Provider as compensation. In case of termination during service delivery, services already performed are billed on a pro rata basis. The Provider may terminate the contract in case of serious breach by the Client of their obligations.
9. Liability
The Provider's liability is limited to the amount of fees received for the service in question. The Provider shall not be held liable for decisions made by Swiss authorities (permit refusal, rental application rejection), nor for delays attributable to third parties or the Client. Indirect damages (loss of profit, moral damages) are excluded.
10. Force Majeure
The Provider shall not be held liable for failure to perform its obligations in the event of force majeure, including but not limited to: natural disaster, pandemic, war, general strike, unforeseeable legislative change, IT system failure beyond our control.
11. Applicable Law and Jurisdiction
These GTC are governed by Swiss law. Any dispute shall be submitted to the exclusive jurisdiction of the competent courts of the Canton of Geneva, Switzerland, subject to mandatory provisions to the contrary.
